On Monday, June 16, 2025, the Town Council passed By-law 2025-095, which adopted Official Plan Amendment 071, under section 17(23), of the Planning Act, R.S.O. 1990, c. P.13, as amended and passed Zoning By-law 2025-096 under section 34 of the Planning Act.

The purpose of the official plan and zoning by-law amendment application is to change the site-specific exception policies applying to the lands to allow for 3 blocks of four storey back-to-back townhouses with rooftop amenities and a mixed-use building along Lakeshore Road West for a total of 48 units, and approximately 170 square metres of ground floor commercial. A total of 76 parking spaces are proposed, 59 of which are in at-grade parking garages below each back-to-back townhouse block. Of the parking spaces, 17 are stacked, with an additional 11 surface parking spaces with six reserved for commercial / visitor parking at the rear of the mixed-use block. The purpose of the plan of subdivision application is to permit the proposed development to proceed as a common element condominium, as the site is not currently within a Block in a plan of subdivision.

The subject lands are located on the northeast corner of Garden Drive and Lakeshore Road West and is municipally known as 105, 115 -159 Garden Drive.

The subject lands are subject to a Site Plan Application (File No. SP.1617.058/02).

The Council’s decision reflects that the comments from the public have been appropriately addressed.

Any appeals to the proposed official plan amendment or zoning by-law amendment must be filed with the Town Clerk, 1225 Trafalgar Road, Oakville, ON, L6H 0H3, setting out the reasons for the appeal and the specific part of the proposed official plan amendment to which the appeal applies; and must be accompanied by the fee required by the Ontario Land Tribunal. Copies of the appeal forms are available from the Ontario Land Tribunal website. 

The proposed official plan amendment is exempt from approval by the Regional Municipality of Halton. The decision of the Town of Oakville Council is final if a notice of appeal is not received on or before the last day for filing a notice of appeal.

Only individuals, corporations or public bodies may appeal a decision of the Town of Oakville Council or a by-law to the Ontario Land Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.
