Notice of intention to pass Amending By-law to remove a holding symbol for Part of Lot 24 and 25, Concession 1 NDS Graydon Banning Limited (Mattamy Development Corporation) ZH1/25, Ward 7

You are invited to provide input as it relates to this application submitted under Section 36 of the Planning Act to remove an “H” holding symbol H42, H47 and H48 from Zoning By-law 2009-189 applicable to the lands located at the intersection of William Halton Parkway at Harasym Trail and at the intersection of William Halton Parkway at Travertine Drive.

These lands are also subject to a draft plan of subdivision (File No. 24T-15006/1324).

A “H” holding symbol is a mechanism to ensure that certain conditions are met prior to the development of the lands proceeding in accordance with the approved Zoning. If the conditions are met, the Town is required to remove the holding symbol upon application by the landowner, by passing a By-law under Section 36 of the Planning Act. Holding Provision Number H42, H47 and H48 requires that the following conditions shall first be completed to the satisfaction of the Town of Oakville:

The water and wastewater Servicing Allocation has been secured for the subject lands and the proposed development through Halton Region; and that Halton Region provides correspondence indicating that sufficient water and wastewater servicing allocation has been secured to support the development.

Holding Provision 47

Sufficient water and wastewater services are available to the satisfaction of the Regional Municipality of Halton and the Town of Oakville.

Holding Provision 48

  1. Adjacent land is no longer being used for the purpose of an AM radio station; or
  2. Analysis/study/testing is completed and documented with respect to such lands to identify and manage potential effects, if any, of the existing AM radio station on future residents, including compliance with applicable standards or guidelines related to potential interference with the consumer electronics and medical equipment (EMCAB-2 and IEC60601-1-2 as of October, 2020) and health and safety (Safety Code 6 as of October, 2020) and further, that any mitigation plan necessary to deal with potential effects is secured, all to the satisfaction of the Town of Oakville and Halton Region.   

The Commissioner of Community Development, or their designate, will be deciding on the application to remove the holding provision on Wednesday, July 2, 2025, at 1:30 p.m.

Although there are no third-party rights of appeal on the removal of the holding symbol, you are entitled to notice and may make written submissions before the by-law is passed. Any submission should be forwarded to the Commissioner c/o the Town Clerk at the Town of Oakville, Clerk’s department, 1225 Trafalgar Road, Oakville, ON L6H 0H3 (Dropbox is located in front of Town Hall) or at townclerk@oakville.ca. Written submissions should be submitted no later than 4:30 p.m. on Monday, June 30, 2025.

All submissions should include the full name and address of the author.
